1. CANCELLATION BY THE BUYER
1.1 No cancellation of the whole or any part of any order, whether it is an order by
instalments or otherwise, by the buyer is permitted except where agreed in
writing in advance by the manager of Black Country Metal Works.
1.2 Goods, once delivered, may not be returned unless authorisation has been given as specified in condition 1.1 and provided that the following conditions are satisfied:-
Goods will only be accepted if they are brand new and unused condition.
Packaged items will only be accepted if the package remains unbroken and in reasonable condition.
Goods will only be accepted if returned within 7 days of delivery.
1.3 Where goods are returned by agreement:- In every case a restocking charge will be made. In every case the invoice number and date, together with reason must be stated.
All refunds which are requested by private or web customers must be put in writing to us.
Once put in writing to us, we will then confirm receipt of the cancellation request by writing back to the customer.
2.1 Black Country Metal Works shall make good by reimbursement of the whole or part of the price ( and where relevant, as a deduction from any part of the price remaining unpaid) or at its option by repair or by replacement any defect developing under normal use in the goods and due solely to faulty design (except where the design is supplied by or on behalf of the buyer) faulty materials or faulty workmanship provided that:- The buyer shall be responsible for ensuring the goods are fit for the purpose for which it wishes to use them and Black Country Metal Works gives no warranty (and none shall be implied) that the goods are in for any particular purpose ; and the defect in question shall have appeared within 3 months for such longer time period (if any) as may be provided for any guarantee
given by or on behalf of the manufacturer of the goods) after the buyer shall have taken possession of the goods or performance of services completed and shall
have been thereupon promptly notified in writing to Black Country Metal Works and any goods alleged to be defective shall be stored in a safe place by the buyer until such time as the company authorizes their disposal in writing; and any goods alleged to be defective shall ,if so required by Black Country Metal Works be promptly returned at the buyer’s risk and expense to Black Country Metal Works for inspection. Black Country Metal Works shall in its responsible opinion consider them to be defective solely by reason of faulty design materials or workmanship; No attempt shall have been made by the buyer or by any third party to remedy and defect before, if so required by Black Country Metal Works, the goods in question shall have been returned to Black Country Metal Works for inspection; and the goods in question shall have been serviced and maintained properly and in the accordance with Black Country Metal Works recommendations and shall not have been fitted with any parts, components, or accessories other than those manufactured or recommended by Black Country Metal Works.
Changed Your Mind? - Returns Policy
If a buyer should change their mind on receipt of goods, there will be a 14 day period in which to notify Black Country Metal Works of the intention to return the goods in perfect, saleable condition, whereby postage will be paid by the buyer. On receipt and inspection of the returned, perfect goods ( within 21 days of receipt by the buyer ), to Black Country Metal Works the customer can, at the discretion of Black Country metal Works expect to receive a full refund for the goods. Goods returned to Black Country Metal Works, in perfect condition, after 21 days will be subject to a restocking Charge of 25 percent of the total purchase price.
Faulty or Incorrectly received goods
Faulty or Incorrectly received goods, are to be returned by the Buyer at the Buyers expense. On receipt and inspection of the goods at Black Country Metal works, should the fault be deemed the responsibility of Black Country Metal Works, then a refund will be given for the full amount paid for the goods and upon receipt of a postal receipt at Black Country metal Works, the full Postal amount will also be refunded to the buyer.
2.2 The company shall in no circumstances be liable to the buyer for economic loss, loss of profit, loss of business or like loss.
Black Country Metalworks Returns Policy - Returns Form & Returns Number
ALL Returns must be made with a completed returns form. These can be downloaded from the bottom of this page. You must email firstname.lastname@example.org and request a returns number (RMA), quoting your Name and Address, Delivery Note Number and goods you wish to return, so that we know what to expect from your return. You agree that if you send a return to us without a returns form and returns number you will pay a £20 administration fee to cover the extra work involved in processing your return.
Faulty Goods - Returns Policy
We will refund the cost of faulty goods and the delivery charge as well as the return postage. Please carefully re-pack the goods, in their original packaging, or packaging of a suitable nature as to fully protect the goods on their return journey to Black Country Metal Works.
All returns are inspected and tested and if the item proves not to be faulty when tested then only the product value will be refunded. You will not be refunded the cost of the delivery to you or the return delivery cost.
Large pallet deliveries
Please be aware that the costs of returning items to Black Country Metal Works will be considerably higher than you are charged for delivery. This is because we subsidise our large pallet deliveries on their outbound journey to the customer.
Goods returned Damaged or used
It is the absolute responsibility of the purchaser/customer to repack and ensure safe and perfect return of all goods being sent back. If avoidable damage occurs through poor packaging, lack of packaging, or if the product has been used, then we reserve the right to reduce the refundable value, depending on the circumstances and the damage incurred, in order that we can repair or replace the damaged item.
Checking Goods for Damage and Notifying Black Country Metal Works
For small deliveries that arrive with carriers you agree to open all boxes and thoroughly check the goods for damage and notify us of any damage within 7 days of the delivery. If we are not notified of damage within 7 days we are unable to claim from either the manufacturer or the carrier. You agree to indemnify us in full for any losses we suffer as a result of your failure to notify us within 7 days.
For bulky deliveries you agree to check the goods for damage before signing the delivery drivers, (GDN) Delivery Note. If you sign for the goods, even if you write the words "Unchecked" or similar on the delivery note, then you are accepting that the goods arrived in good condition and later claims for damages will not be considered. If the driver refuses to wait while you check the goods then you must refuse to accept the delivery and email email@example.com with the details as soon as possible. If someone else is signing for the goods on your behalf you agree to advise them that the goods must be checked and you accept full responsibility for any loss or damage if they sign on your behalf and fail to check. You agree to indemnify us in full for any losses we suffer as a result of you or your agent accepting goods and signing a delivery note without thoroughly checking the goods for damage.

If you change your mind about the product you purchased when you receive it you can return it at any time within 7 days for a full refund of the product cost.
It is your responsibility to ensure that returned goods reach us in a perfect, resaleable condition. They should be well packed, in the original packaging or packaging of an equal quality and sent to:
